Ashiana Palm Court Residents Association

  1. First of all BE UNITED and Keep ringing Ashiana until they clarifies the whole situation and give us a final commitment.

    Don't decide dates of meeting by yourself.
    Go To Ashiana and get a date from them within a month.


    All of you are requested to call Ashiana and take a date from them of meeting asap. In case of not a good response, we will wait till end of october. After then we will go to ashiana office or take some legal step.


    In case they gives u any date for meeting within a month, please post that on blog. We will try to assemble on that date at the venue. Moreover force them to give meeting dates only on weekends/public holidays


    We should register our association as soon as possible.

  7. Ghaziabad, is very strategically located, in terms of two National Highway passing through it, i.e., NH-91- the G.T. Road and NH-58 - the Meerut Road

    Insist on deadline in building contract

    Whenever you enter into a contract with a state-run land development authority, or a private builder to buy a house or a flat, check if there is a deadline for completion of the project and handing over possession. If there is no such time stipulation, write to the builder, drawing his attention to it, and persuade him to set a time limit. If there is a delay beyond this period in completing the construction or handing over possession, say so in writing. If you want to seek compensation for the delay, do so at the earliest. Or else, you may well lose your right to seek damages.

    Take the case of Ashok Khanna vs Ghaziabad Development Authority, decided by the apex court recently. Here, the consumer applied for a flat in 1988, paid the registration fee of Rs 60,000, and subsequently, the entire amount of Rs 5,40,000 as per the schedule fixed by the GDA. According to the customer, the GDA promised in its brochure that possession would be given in 1990, but it was done only by the end of 1993, after collecting an additional charge of Rs 57,000 towards escalation of costs.

    The client paid the amount, took possession, and then in 1995, filed a complaint before the court, seeking damages for delayed delivery of the flat. While the district consumer disputes redressal forum awarded compensation, the state consumer disputes redressal commission held that the customer was not entitled to any relief as he had taken possession of the flat without raising any objection about the delay.

    In his revision petition before the national consumer disputes redressal commission, the client argued that the GDA was guilty of deficient service for not giving possession within the stipulated period of two years. The GDA, on the other hand, argued that the brochure only said that the construction shall be completed within two years from the date of reservation of the flat. No definite period was prescribed for delivery of possession.

    While deciding the case, the national commission referred to the order of the Supreme Court in the case of Bangalore Development Authority vs Syndicate Bank (2007 CTJ 689 (Supreme Court, CP) wherein the apex court had said: "Where no time is stipulated for performance of the contract (that is for delivery), or where time is not the essence of the contract, and the buyer does not issue a notice making time the essence by fixing a reasonable time for performance, if the buyer, instead of rescinding the contract on the ground of non-performance, accepts the belated performance in terms of the contract, there is no question of any breach or payment of damages under the general law governing contracts."

    The national commission then referred to clause 16 of the brochure of the GDA, which, under "Time of completion of apartments," said: "The apartments are expected to be completed within two years from the date of reservation." On the basis of this, the national commission held that time was not the essence of the contract here. To the question on whether there was negligence on the part of GDA in handing over possession, the national commission pointed out that (a) the brochure did not mention any specific date of delivery of possession of the flats; (b) no agreement was entered into between the parties stipulating any time for performance or delivery of flats; (c) the consumer did not rescind the contract on the ground of non-performance.

    He accepted the delayed performance in terms of the contract; (d) at the time of delivery, the client paid the additional amount without any protest. Nor did he make an issue of the delay; and (e) he took possession in 1993, but filed the case only in 1995, which showed that at the time of delivery, the customer was satisfied, but later changed his mind and filed a complaint.

    On these grounds, the commission said the buyer was not entitled to any compensation (RP NO 2002 of 2005, decided on August 18, 2009).

    I am Namish Saxena (9891290680). I have booked a flat P3-016.

    I am an IT consultant by profession and currently putting up in Rajnagar.

    After reading all your comments and thoughts following is my view:-
    - I would like to suggest to everyone to be on same page while talking/posting anything.
    - I am not sure what is the issue people are trying to post and then resolve. Just by seeing/ hearing the information somewhere doesnt help all of us at all.
    - We all soon be a family so I request all of you to work and proceed in a united fashion.
    - Starting this blog is a very good idea but from my perspective we are not utilizing this properly to its full potential.
    - Moreover we are trying to collect the information (phone, email etc) about all of us but again that is not a proper way to do so.

    I kindly request all the residents of the Ashiana palm court to do the following if everyone agrees:-

    1. PEOPLE SHOULD SEND THEIR VALID EMAIL-ID & PHONE NO TO ONE PERSON WHO COLLATES ALL SUCH INFORMATION AND THEN DISTRIBUTES THE SAME.
    2. PEOPLE SHOULD SEND ALL THE CONFUSIONS/QUERIES/CONCERNS/DOUBTS/FEARS/UNCERTAINITY/ISSUES TO ONE PERSON WHICH THEN BE COLLATED AND ADDRESSED.
    3. PEOPLE SHOULD AVOID POSTING ANY POST AS "ANONYMOUS" AS THIS LEADS TO CONFUSION
    4. PEOPLE SHOULD ALWAYS SIGN THEIR POST WITH NAME & FLAT NO.

    As i am requesting everyone so i can take the ownwer ship of collating all the details and publish the same. Once I will have the email id I will form a email group and we will share all the critical information there as this blog is public and accessible to everyone.

    I am manish Pandey booked flat no 1029.
    There are few comments which are not matching with ashiana committment.

    1.when i booked the flat they told me they had the approval till 11th floor and selling till 10th floor only but planned till 14th floor and waiting for approval, even their site model at sales office was 14th storie.

    2. when i booked the appartment, tower P1 AND P2 WAS SCHDULED IN DEC.09, TOWER P3 MARCH 10 and P4 AND P5 june 2010. AS PAR THE PRICE LIST.
    NOW THEY HAVE EXTENT THE POSSESETION TIME.
    I have enquired abt the this extent possesision time,they told me, to make smooth possession process to old allotees they have increase the possession time for new buyers only ,this is not applicabl;e for old allottees. If this is true then i don't find any problum.
    But yes Tower P1 and P2 is deleyd by 3 month because they are planning to deliver in march 10.

    As par my knowledge Ashiana has very good reputation in the market so i hope for the best.i frequently visit the site pace of construction is fine.

    Considering the fact MAJOR BUILDER CONSTRUCTION ACTIVITIES WAS DEAD IN THE NCR REGION AT LEAST FOR 6 MONTH IN 2008 BUT ASHIANA NEVER STOP THE CONSTRUCTION.
    IF I GOT THE POSSESSION WITH IN THE TIME FRAME OF 3 MONTH DELEY I FEEL RELAX AND DELIGHT.

    Gyanendra Kumar, a non-resident Indian (NRI), booked a builder floor in Indirapuram, a suburb just beyond the eastern limit of the capital city. Having savoured the advantages of the tube abroad, one of Kumar’s criteria at the time of buying the apartment in India was that it must be located in an area that has, or will soon get, Metro connectivity. The developer of the apartment complex in which he finally bought a flat assured Kumar that the Delhi Metro is being extended and will reach Indirapuram soon. However, the reality is that no expansion plan exists at present for extending the Metro route beyond the places specified in the Delhi Metro Master Plan 2021. Contrary to builders’ claims, no plan to extend the Metro beyond Vaishali in east Delhi, or Sector 32 in Noida, Uttar Pradesh, Badarpur in south Delhi and Mundka in West Delhi exists at present.


    When contacted M Ramchandran, Secretary, Ministry of Urban Development told The Indian Express that no proposal for extending the Metro beyond Vaishali or Sector 32, Noida, exists. “No such proposal is pending with us,” he said. The Urban Development Ministry, which is the apex body that approves Metro corridors, has not received a formal proposal from the Uttar Pradesh government for extending the Metro beyond Vaishali in Ghaziabad, or the Yamuna Bank-Noida corridor beyond Sector 32.


    Recently, the Minister of State for Urban Development Saugata Roy told Parliament: “There is no proposal from the UP government to extend the Metro line up to the CISF complex on NH-24 in Indirapuram.”


    AUTHORITIES TO BLAME TOO


    If builders are to blame, then so are some of the land development authorities in the neighbouring states, such as Ghaziabad Development Authority (GDA) and Haryana Urban Development Authority (HUDA), who have lent credence to these claims. It is true that these authorities have, in the past, proposed to the central government that the Delhi Metro be extended to areas under their jurisdiction. Both GDA and HUDA have prematurely put out maps that display the extended routes, when in reality these have not received the approval of the Urban Development Ministry. As Saxena says: “These proposals are either pending or have been rejected outright by the Urban Development Ministry.”


    If you want correct information on the routes that have been approved, the map to look up is the Delhi Metro Master Plan 2021. Developers too need to make the all-important distinction between a mere proposal and an approved project. “They need to mention clearly that these are mere proposals instead of promoting their areas as if they have already been marked for Metro connectivity,” says Santhosh kumar, CEO – operations, Jones Lang Lasaale Meghraj.


    BUYERS TAKEN FOR A RIDE


    Meanwhile, touting the advantage of Metro connectivity on the basis of these very tenuous proposals, developers, especially in the eastern suburbs of Delhi, have sold thousands of flats. Clearly buyers need to cross-check instead of swallowing developers’ claims hook, line and sinker. Says Nitin Saxena of All India Consumer Right Education society: “Homebuyers need to beware of private developers who claim that their projects lie on or close to the Metro rail link. These developers are misleading buyers to boost their sales by claiming that the Metro will reach their doorstep by the 2010 Commonwealth Games. Many of these Metro projects have not even received sanction, leave alone being close to completion.”


    By advertising that their projects are situated close to the Metro link, many developers have managed to get a good response to their projects. “Such projects attract a large number of investors. They believe that with the Metro link the prices of these apartments will rise, and hence investing in them will be a very profitable venture,” says Vineet Singh of 99acres.com.


    Mohit Arora, director of Supertech Builders, believes that booking apartments based on the proposed maps is not unethical.
